Turns out I didn't - and this book was a huge part of that. The next bit of advice I really liked regarding trademark was the idea of not trying to shove the service or product you are trademarking down everyone's throats - your trademark doesn't have to explicitly describe what you are offering to the public....your marketing will do that for you. After all, what is Google? You create your name, your trademark and keep your services separate. This book is definitely a good start to showing you how to prepare a trademark, beyond the differences of copyright and trademark, but be forewarned that it doesn't tell you explicitly the step by step process. It is more for those who are on the fence about it in general and how to decide when your brand is at that step.

Great quick read on trademark law, how to protect yourself, the risks to your business and three easy steps to evaluate a trademark for your business. I am really thankful I read this as it gives me a deeper perspective of developing logos for companies. Now I will feel confident that I have a sustainable product. I wish there were more legal jargon and more in depth look at the complexities but I suppose that’s why they suggest hiring a professional! Would suggest to any new business owner looking to understand the tech business platform.

After all, what is Google? You create your name, your trademark and keep your services separate. As a young woman starting her own brand I found this book incredibly valuable. Going into this book I had pretty much zero knowledge about intellectual property and now I feel prepared to protect and grow my brand. I, myself, didn't know how important it was until I read this book which explains why you should and the possible risks in not doing so. Turns out I didn't - and this book was a huge part of that. The next bit of advice I really liked regarding trademark was the idea of not trying to shove the service or product you are trademarking down everyone's throats - your trademark doesn't have to explicitly describe what you are offering to the public....your marketing will do that for you. After all, what is Google? You create your name, your trademark and keep your services separate. This little book was quite a gem to have. It’s filled with great resourceful information. One thing I loved about reading this book is that it considers all levels. Starting from the basics of explaining what exactly a band is, to explaining more in-depth knowledge of how to protect your brand by trade making it. I really loved the egg analogy breakdown In explaining generic vs distinctive brands and learning ways to prevent your brand from getting rejected. I stumbled upon this book as I was getting ready to start my own business and I knew very little about how to protect my brand. Turns out I didn't - and this book was a huge part of that. The next bit of advice I really liked regarding trademark was the idea of not trying to shove the service or product you are trademarking down everyone's throats - your trademark doesn't have to explicitly describe what you are offering to the public....your marketing will do that for you. After all, what is Google? You create your name, your trademark and keep your services separate. This book is definitely a good start to showing you how to prepare a trademark, beyond the differences of copyright and trademark, but be forewarned that it doesn't tell you explicitly the step by step process. It is more for those who are on the fence about it in general and how to decide when your brand is at that step.

Easy to read 3 step process

Great quick read on trademark law, how to protect yourself, the risks to your business and three easy steps to evaluate a trademark for your business. I am really thankful I read this as it gives me a deeper perspective of developing logos for companies. Now I will feel confident that I have a sustainable product. I wish there were more legal jargon and more in depth look at the complexities but I suppose that’s why they suggest hiring a professional! Would suggest to any new business owner looking to understand the tech business platform.

Select, secure, sustain... Am I TM infringing?

In case you couldn't tell I was under the impression that a copyright and a trademark are if not the same then at least similar. I think in my mind I thought copyright was for things while a trademark was for ideas. After reading, well, I actually still don't know the ins and outs of a copyright (duh, but I guess I do know what my next read will be) however thanks to this book I know *A LOT* more about trademarks including my favorite piece of advice: “the task of describing the product or service offered under your brand name is best left to advertising and marketing; not as part of your brand.” Which really kind of blew my mind upon reading because it really sums up the spectrum of “strong brands” *and* I happen to think it's advice applicable to more than just the TM side of business. Oh, and that slogan of the 3 S's? It's ABSOLUTELY the best way to describe *and* sum up the book (and it's also a stellar example of a TM). First you select (you choose a strong brand), you secure (as in you register) and you sustain (because as the book points out once your brand is registered it doesn't go sit in a drawer, you have to monitor it or face the risk that it be sucked into public domain; like aspirin! Who knew?) 3 S's easy to remember, don't know if it's as easy to do but I'm happy to walk away with that easy to recall bit of knowledge. This read to me was filled with really interesting information, from learning about the four horsemen (no, not the apocalypse ones) to that trade dress has little to do with a gown made of fabric (though if you think about it *it could*) I not only enjoyed reading it but I also ended the book having learned quite a few things. But were they the ones that were “promised?” Meh. And that's the one thing I'm on the fence about. As much as I liked this book, and though it *does* prepares you to register your trademark it does so in the light of “general ideas” (as in things to take into consideration like how to tell how strong your brand is) but it doesn't actually “prepare you” as in it doesn't say which offices to go to, any estimates on how much legal services might cost etc. However, I won't deny it isn't *completely lacking* of those details, as it does speaking of them (though again in general terms) and I do appreciate that it also warns that “If you have decided to file on your own, understand how non-lawyer filing services work and the limitations upon the services and skills they bring to the process.” Which is very sound advice. I also have to concede that the book “warns” on the copyright page that: “This publication is designed to provide accurate and authoritative information in regard to the subject matter covered and is sold with the understanding that the publisher and author are not engaged in rendering legal, accounting or other professional services. If legal advice... is required then the services of a competent professional should be sought.” Which is all true, they *didn't* promise me a step 1-2-3 in a more practical aspect they just “promised” *more general scope* in the preface where it says that this guide “empowers you to successfully protect and grow your business, including brand assets, by securing the benefits of protection from registered trademarks. Business owners... will learn how to use registered TMs as a cost-effective way to immunize the life of a brand against today's many cyber threats... The GUIDE provides a simple 3-step plan which when followed will greatly increase the chances of securing registered TMs...” Guide is in caps because in the book it's in italics (in my opinion to emphasis that IT IS a guide, no more no less). And those “safe promises” I'd say ARE true after reading, save the “cost-effective” part as, well, like I've been saying, on the one side it's an implied cost-effectiveness when the other option is being sued but can it *truly* be called cost-effective if I have no idea how much hiring an attorney or any other part of the TM process actually costs versus using the “limited filing on my own”? And are those few words of caution enough? I don't know and so that is why I'm on the fence, perhaps it's something, perhaps it's nothing but to me it was the thing that left me... I hesitate to say unsatisfied, but I'm also not completely satisfied. Yes, it's also kind of nitpicky but there you go. Oh, and also the link to the additional “plan your steps” guide didn't work for me which was disappointing. So, overall this book was an interesting read and despite my one point of contention as it's a nonfiction that DOES speak on the topic it claims I can't but rate it 5 stars; objective mission accomplished. I'd recommend this book to any newbie who wants to learn more about trademarks but keep in mind that if you're actually interested in filing for one you'll have to do more legwork/research than merely reading this guide otherwise I'd say it's definitely a wonderful introduction to the topic.

The most thorough content I ever read on trademarking

I got so much out of "Registered Trademark" as it helped me to fully understand the importance of trademarking as well as the many facets of the process and its history. Trademarking was something I kind of understood but never quite grasped. I have researched the topic here and there online but articles just didn't seem like they explained everything. Enter the book "Registered Trademark" that effectively explains the point of trademarking and really gets down to the nitty gritty of it all. I especially appreciated the fact that the author listed several different trademark scams to look out for. I actually have been a victim of "cybersquatting" and wish I could have read this book before giving in and paying a large sum of money just for a domain name. This particular subject, along with many more in the book, is so valuable and makes this book extremely necessary in terms of brand protection and trademarking.
